You cannot expect to report the crime/video to the cops without any repercussions for yourself. It is a federal felony to hire a foreigner without employment authorization (even if the person is not an illegal immigrant) - this means, if you are convicted, you can end up in prison, lose your property, pay fines and of course you will be deported. If you have been paying them and did not disclose this to the IRS, both you and they are liable for tax fraud, in addition. This is very serious. You should hire a lawyer if you want to deal with them legally.

Hi, Please let me know your thought on my situation. I was on H1 thru Company A. I don't have pay stubs for the last 3 months of 2005 since i was on bench, but got the salary that is mentioned on LCA in pay stubs till end of Sept. When I asked my employer to pay me for the time on bench he said that he has paid the LCA salary and doesn't have to pay.
So having said that, am I in Status or Out of Status?

Recently all of us in the IV community were thinking and worrying about what the future holds for skilled immigrants in this country. Day by day things are getting tougher! All of us in IV community (including the leadership) have different ideas about how to approach the problem. Under the IV leadership, we have a set of declared priorities and our lobbyists and community are working for those. Even when we work for those stated goals and priorities, we have to reevaluate what is feasible in the changing environment.
In this increased protectionist environment, Re-Capture, Country Cap Elimination and Immigrant Visa increase seems difficult if not impossible. So, I would like to propose a SMALL STEP, which would provide us HUGE BENEFITS and at the same time satisfy all stakeholders (including anti-immigrant community) as this is the least controversial method.
Some of us may say that this won�t work. Some of us support a big-bang theory. Some others argue for the already stated goals and priorities from the IV leadership team. I agree with all these groups of our brethren, but at the same time, I urge each and every member of our community to give a serious consideration of this proposal before shooting it down.
Please do not use this thread to point fingers at one another. Always remember, when you point fingers at someone, three of your fingers are pointing towards you and one stays neutral. Please try to avoid statements like the following in your reply to this post to encourage serious and productive discussion:
�Why didn�t you update your profile with all information?�
�What have you done so far for the community?�
�Did you participate in these so and so initiatives of IV?�
�You are a line cutter who used substitution�
Etc etc etc�the list goes on.
We have far more things that unite all of us than the few things that divide us. So, let us focus only those things that unite all of us. If we are united, we can easily solve all our differences. As AR Rahman said, always we have the option of choosing love over hate.
PROPOSAL
Our main concern with respect to GC journey is the UNCERTAINITY! I am sure all of us worried at least one time �What happens if my 485 gets denied after all these years of waiting?� Many of us here are expecting a GC wait time of 2-12 years. So, a denial at the end would be little bit disheartening.
The normal processing time of a 485 application ranges from 4 months to 12 months. For all the retrogressed countries, this would be 2-12 years. All of us, who are in the Adjustment of Status category, are legally allowed to stay and work here in the US. So, in no way we are additional burden to the country. So, all the shackles on the GC applicant and family during the years of retrogression period are not beneficial to anyone in this country and it is not protecting anyone�s job. These shackles just inflict pain to the GC applicant and family � that's all - nobody is benefitting from this!
So, if we can work to obtain Adjudication of all I-485s irrespective of whether the country is retrogressed or not � we have a solution. As per the INS rules, an immigrant VISA cannot be allocated outside the numerical limit. If the country is not under retrogression, the applicant will get his GC. If the applicant�s country is a retrogressed one, instead of obtaining the Green Card, I-485 processing-status could be changed to a new one such as �Adjudicated � Pending Visa Allocation� (meaning: Adjudication completed, Visa allocation pending). So, in essence, when the VISA numbers are available, then only the person will get Green Card. But at the same time, the applicant and family can feel the relief � No need to worry about RFE, NOID, MTR etc, because the 485 is already approved and it is in a Pending Visa Allocation status. So, in the case of all these retrogressed countries, the actual allocation of Green Card may take 2-12 years time depending on the availability. This option will go well with the protectionists.
If the status of the 485 application is �Adjudicated � Pending Visa Allocation� and the applicant�s country is a retrogressed one, S/he should be eligible to obtain 3, 4 or 5 year EADs with travel benefits associated. Also, the applicant should be able to take any job after 1 year of the status change date of the status �Adjudicated � Pending Visa Allocation�.
I believe the above proposal is a small step in the eyes of the protectionists where as it is a big leap for all retrogressed country applicants. We may be able to achieve this using administrative fix or an action from the Executing branch, as this won�t change the annual GC quota of 140000. Apart from this, this will encourage all those skilled immigrants to invest in American economy within 1-2 years of filing AOS application. At present most of us are sending our money to our home countries as our situation is so uncertain. This effort will definitely help the ailing economy and will serve as a boost to the housing market.
Whom should we approach to get this done?
Ans: Hillary � Yes Hillary Clinton. She is the number 1 friend of people from China and India, who is in the current administration. Her department is also in charge of the 140K Visa numbers, Travel related visas etc. If we can get support from Compete America, prominent members of Indian and Chinese communities in US, Ambassadors of China and India to US and approach Hillary, we will be successful. Hillary may be very much pleased to start an initiative to achieve this, as she has a chance to influence 700K+ Indians and Chinese immigrants in US, in a very positive way. At the same time, politically this won�t create much problem � Status quo will remain the same � even after such an administrative fix. There is no net addition of immigrants to this country.
With Hillary�s support, if we approach Janet Napolitano, we may have a solution.

So, once we obtain this admin fix (first step), then we will work to obtain the Allocation of GC issue for all those folks who are waiting to get the GC allocated.

One small step for IV, one giant leap for IV members.

If you don't, assume you did and contribute your bar tab to IV.
I have been pained by many comments on the "Bulletin Update" threads earlier about IV misleading its members on the timing of the bulletin etc. How many of you go around telling that you have $100,000 in your bank account?
All those folks who doubted IV and claimed IV mislead them on the timing, should apologize to the CORE team publicly.

Great discussions!! we are all going in different directions... How many Labor petitions few handful? There might be ppl who are stuck legitimately and ppl who did it , it was legal. Rather we should concentrate on Retrogression of VISA numbers. Then what after July 07 , think also about 140's there were pending there are a handful with earlier priority dates. Also many times USCIS issued GC's for ppl with earlier PD's should they return their GC back ? And potato eater has mentioned its not point to argument. I dont think there are those who are blocking the system. It is sheer number of VISA's that are driving nuts. There were also proposals that VISA numbers be applied only to principal applicants. Actions like these will have impact on final numbers.
And above all this idea is not new , It was even discussed by many members (in ~2006) when Substitution was abolished. But we are already here. We will campaign like Rajiv Khanna had said and then what discuss new proposal ? I feel its not that easy to do a change for existing ones in pipeline and USCIS has completely abolished this idea altogether.
Main action agenda: Legislation to get back unused numbers. I dont want IV to waste energy or resources anything beyond this and we shouldnt keep on discussions of new proposals. Our only point of discussion should be How to get legislative fix done.
Come to think of it, this idea has potential to fly. We can ask CIS to make the date of I-140 filing as the PD for substituted labor case. This will ensure that PD will move forward smoothly till July 07 at least. That will cover most of the long standing ( and long suffering) GC applicants and bring them relief. This will not have any other impact on the number of outstanding apps or available visa numbers etc. I guess this change in PD assignment logic can be done by CIS without the need of any new legislation.
The idea inherently appeals to those who believe in fair play. How do we take this forward.

You can call this also as jealous. There are too many people from the other countries will have to wait because not having people to mass migrate to US. Arguments can be made in way. So be sympathetic. Your issue may not an issue for me. Do not call it as jealous

This might be an error but is causing problems and Inconvenience and injustice to some innocent people. You can call it as jealousy. That is alright but they have an issue which they need to fight. However small number may be it can benefit these guys.

I also looked around for subLC, could not get one and had the same state of mind. I was not willing to take risk for it, like leaving my current job etc. so I know first hand the exact state of mind.

This system of records notice enables DHS/USCIS to provide automated support to process applications and/or petitions for benefits; determine the status of pending applications and/or petitions for benefits; account for and control the receipt and disposition of any fees and refunds collected; conduct searches pursuant to FOIA and Privacy Act requests; and locate related physical and automated files to support DHS/USCIS responses to inquiries about these records.
Categories Individuals Covered: Persons who have filed (for themselves or on the behalf of others) applications or petitions for immigration benefits (other than asylum and refugee) under the Immigration and Nationality Act, as amended, and/or who have submitted fee payments or received refunds from such applications or petitions; current, former and potential (e.g., fianc[eacute]) family members of applicants/petitioners; persons who complete immigration forms for applicants and petitioners (e.g., attorneys, form preparers); name of applicant's employer; and individuals who seek access to records retained in the Benefits Information System under the Freedom of Information/Privacy Acts (FOIA/PA).
Categories of Records in the System:
Individual's name;
Social Security Number (if applicable);
A-Number (if applicable);
Addresses;
Telephone numbers;
Birth and death information;
Citizenship or nationality;
Immigration status;
Marital and family status;
Personal characteristics (e.g., height and weight);
Records regarding tax payment and financial matters;
Records regarding employment;
Medical records;
Military and Selective Service records;
Records regarding organization membership or affiliation;
Biometric and other information collected to conduct background checks;
DHS issued card serial numbers;
Records regarding criminal history and other background check information; and
Case processing information such as date applications were filed or received by USCIS; application/petition status, location of record, FOIA/PA or other control number when applicable, and fee receipt data.
Record and Information Safeguards: Records in this system are safeguarded in accordance with applicable rules and policies, including all applicable DHS automated system security access policies. Strict controls have been imposed to minimize the risk of compromising the information that is being stored. Access to the computer system containing the records in this system is limited to those individuals who have a need to know the information
for the performance of their official duties and who have appropriate clearances or permissions. The system maintains a real-time auditing function of individuals who access the system. Additional safeguards may vary by component and program.

If he goes to cops what happens to his 485? He is worried that's why he is on this forum - I think he was looking for posters with similar experiences and whether complaining to cops worked or not.
Is 485 the sole purpose of our life now ? Personally I don't give a damn about the GC if I have to see my family suffer and I don't think any crime can be worse than seeing an adult abusing an infant who can't protect himself and not doing something about it.

You never cease to amaze me, impress me, and educate me.
You have taught me that this goes beyond just getting our green cards.
This is the difference between people that succeed in life and people that don't, people that bring change to the world and people that sit around hoping the world will change for them.
In you, and many others on IV, I see that kind of drive and motivation, and I hope to absorb some of that positive energy.
At times I have wondered why I do this, when most people that I know, who are in a similar situation don't. But I have always come out of that thought process with nothing but reaffirmation of my actions, and the intent to continue doing what I do, thanks to IV members like yourself.
I might get my green card in another year or so, but seeing the unwavering motivation and passion with which some people continue to challenge and change things that aren't right, makes me want to continue doing whatever little or large I can, to help them (and help myself in the process!).

If we can even collectively demand official data, which I think we are entitled to, it will help IV community in estimating the wait times for individual cases. It may also help USCIS in correcting their projections and forseeing the demand.

Currently NSC processing time for employment based 485 is 15th Sept. 2007... My notice date is 18th Sept. 2007 (based on case status shown on USCIS site)
Looks like I am going to miss my GC by 3 days and wait till next year :mad: I highly doubt that dates will stay at 2005 during next month bulletin.. (I truly hope I am wrong!)
Published dates are approximate dates for a ball park idea on where cases are for minimizing phone calls. If published date is Sep 8, 2007. It could have a very wide window of reality between (i) someone has looked at least one case of this date, or (ii) All cases upto this date have been seen. Most likely reality is close to first, as USCIS asks you to contact them if your 'receive notice date' is prior to the published date (suggesting that normally they expect all cases by the date should have been processed).
This suggests that there are cases with 'receive notice date' AFTER the published date, which have been opened. So, be optimistic, and hope for the best.
