On March 12, 2002, the House passed such an extension. Section
245(i) of the Immigration and Nationality Act was first enacted as a temporary
provision in 1994 and has been extended several times since then. It enables

Granted Native Americans were here first but at that time America was just a land inhabited by people and it was not a nation. A nation is defined as having the following characteristics (These are UN definitions)
1. Has space or territory which has internationally recognized .
2. Has people who live there on an ongoing basis.
3. Has economic activity and an organized economy. A country regulates foreign and domestic trade and issues money.
4. Has the power of social engineering, such as education.
5. Has a transportation system for moving goods and people.
6. Has a government which provides public services and police power.
7. Has sovereignty. No other State should have power over the country's territory.
8. Has external recognition. A country has been "voted into the club" by other countries.
So America was never a nation before it became America.
Regarding you second point about Columbus, Christopher Columbus was not here look for a promised land, he and other pioneers were here to find trading opportunities. Get your history straight, India was known for Spices and Gold at that time and the pioneer wanted a piece of it. Now India has nothing to offer, other then a piece of its humongous population.

So folks
We are in the Subset of 140 Approved in TSC and 485 applied in NSC (07-28 Lud)
it seems our 485 could have been transfered to TSC
the LUD was for the Transfer i guess
we have now to look at TSC Dates for our RNs
looks like long time to go !!!!

Can someone please clarify this to me?
I'm really confused with the rule right now. Since my last entry was Apr 2007 and I worked only from July 2007, was I out of status?
I've read this -
Out of Status is counted only since last entry in US for employment related I-485. And Section 245(k) covers out of status upto 180 days.
And I've read this from somewhere too -
For a new H1B, a grace period of up to 60 days is allowed before you can start work after entering the country.

Let me be very clear about what we are looking for
Your story about how you are affected by retrogression/back log etc. It could be as simple as 'I have a BS in Engineering and am stuck in back log for 2 years and cannot fulfil my dreams professionally' to 'I have a PhD in Nuclear Science and US needs me coz there are only a handful of us!' Anything and everything works.
I have literally recieved stories of stay at home moms (because of H4 they cannot work) to folks who have been interviewed by MIT! The whole spectrum helps.....please please send us your stories...we need all the weapons when we go face the senators on behalf of IV
As another fellow IV member who just sent me his story clearly mentioned, and I quote him
'Hope my story adds another spoke in the wheel. The thought of having to wait 2-3 or even more years just to be able to file the I-485 is damning. It's time to quit whining and do something about it. Want y'all to know that I'm available to help out in any way I can.'

Has anyone got an idea of unused visas from EB1 and ROW EB2?
It just can't be right the EB2 movement for India and China is hardly moving since EB1 is current and EB2 ROW is current since 6-10 months.
Which category does the unused/overflow visas go?
None of the lawyers I emailed have an answer (they like this retrogression btw more $).
USCIS doesn't care if a non citizen asks a question.

and see from which IP Address, GC status is sending those messages. Find out the location from where he is sending messages. Dont spread false news.

Does LUD on I 140 necessarily tie to 485 receipt generation? I don't think so - why would they touch the already approved I 140 case to begin processing 485? Unless I am missing something...
My I 140 has been approved in Feb 07 from TSC and 485 application was mailed to NSC on July 2nd. No LUD on 140 and no 485 receipts yet...
My BELIEF is that these LUD updates are for NSC filers whose I-140s have been approved at TSC. This is my belief based on certain recent receipt notices so pls DONT take this as the gospel truth.
As with everyone, I am trying to figure out if there is a Method to the USCIS madness.

If we can even collectively demand official data, which I think we are entitled to, it will help IV community in estimating the wait times for individual cases. It may also help USCIS in correcting their projections and foreseeing the demand.
